  1. PURPOSE OF THE CALL FOR TENDER

The General Manager of SONARA launches an Open National Invitation to Tender for the renewal of the SONARA’s triennial insurance program (2020 – 2021 – 2022).

  1. CONSISTENCE OF SERVICES

The services to be performed are divided into three (03) separate lots, which cover three (03) categories of exhibitions, including:

  • risks of SONARA’s property and risks of transporting products;
  • risks of civil liability;
  • and the car fleet.

The consistency of these services is detailed in the Terms of Reference (TOR) attached to this ITT.

  1. EXECUTION DEADLINE

The maximum time limit laid by the project owner for the realization of services, subject of this tender is: Thirty-six (36) months divided into three (03) periods as follows, as from the date of notification of the order of the corresponding service, start the services:

  • Unconditionnal Tranche: twelve (12) months
  • First conditional phase: twelve (12) months
  • Second conditional phase: twelve (12) months
  1. NUMBER OF LOTS 

The services covered by this project consist of three (03) lots divided as follows:

LOT N°1: SONARA PROPERTY INSURANCE AND PRODUCTS TRANSPORT RISKS

The risks of the inheritance and the risks of transport of the products are events which can affect the technical installations, the units, the offices, the residences of function of the cities, the computer park, the software, the data in machine and the financial consequences of the stoppage of production following a major disaster. These exposures will be covered under the following nine (09) policies:

  • All Risk Except port facilities;
  • All risks Except storage units and utilities;
  • All Risks Except loading area;
  • All Risks Except Computer Process;
  • Global Damages;
  • All Risks IT Offices;
  • Multi-risk offices, cities;
  • Transportation of raw and finished products;
  • Maritime and Air Faculties.

LOT N°2: CIVIL LIABILITY INSURANCE

Liability insurance is intended to cover SONARA against the financial effects of recourse initiated by third parties, where they experience damage as a result of the refinery’s activity. In this case, if at the end of the review of these remedies, our responsibility is retained, the insurer will take care of the damage repairs. This risk will be covered by the following seven (7) policies:

  • Civil liability first line;
  • Civil liability second line;
  • Third line civil liability;
  • Marine Civil Liability;
  • Civil liability Infirmary;
  • Sports Civil Liability;
  • Civil liability victualling.

LOT N°3: AUTOMOBILE PARK INSURANCE

Although part of heritage assets, the fleet of SONARA is exposed to a wide variety of damage including RC, theft, explosion, fire. This non-exhaustive range of risks is covered by four (04) policies, depending on the use and age of the vehicles; it’s include:

  • Fleet (excluding TPV);
  • Car park (excluding TPV);
  • Civil Responsibility for construction machinery;
  • Civil Responsibility for staff on mission.
  1. ESTIMATED COST

The estimated cost of operations over the thirty-six months, as recorded in the internal preliminary studies support, is as follows per batch:

  • Lot n°1 (SONARA property insurance and products transport risks): CFAF 10,732,500,000 (nine billion seven hundred and thirty-two million, five hundred thousand)) All taxes included;
  • Lot n°2 (Liability insurance): CFAF 894,375,000 (eight hundred and ninety-four million, three hundred and seventy-five thousand) All taxes included;
  • Lot n°3 (Automotive park Insurance): CFAF 232,537,500 (two hundred and thirty-two million, five hundred thirty-seven thousand and five hundred) All taxes included.
  1. PARTICIPATION AND ORIGIN

6.1. For lots 1 and 2:

Participation in lots 1 and 2 of this invitation to tender is open to insurance companies under Cameroonian law, which are not subject to the sanction of CIMA and which are not in dispute with SONARA.

In order to avoid any concentration risk, bidders must form groups of two (02) companies minimum for submission. The cumulative absorption capacities of the reinsurers of the group must absolutely exceed 250 billion CFAF.

For each grouping, the submission must present:

  • the co-insurance distribution agreement setting out the terms of repayment of premiums to co-insurers;
  • the subscription capacity of each of the companies on the day of submission (Own retention, optional conventions and two (2) last balance sheets.)
  • the premium applicable for each policy.

6.2. For lot 3:

This lot 3 of the invitation to tender is open to Cameroonian insurance companies holding a license in force and which are not subject to the sanction of CIMA, or not already disciplined by bodies in charge of public procurement and not in dispute with SONARA.

  1. FUNDING

The services subject of this invitation to tender are financed by SONARA budget.

  1. ELIGIBILITY OF OFFERS

In order to avoid rejection of his bid, each tenderer must attach to his administrative documents, a submission guaranty issued by a first-rate bank approved by the Ministry of Finance listed in file n°11 of the ITT, up to the fixed amount per lot as below, and valid for thirty (30) days beyond the original bid validity date:

  • Lot n°1: CFAF 180,000,000 (one hundred and eighty million);
  • Lot n°2: CFAF 15,000,000 (fifteen million);
  • Lot n°3: CFAF 3,900,000 (three million nine hundred thousand).

Subject to rejection, other administrative documents required will imperatively be produced in originals or certified copies by the issuing authority in accordance with the provisions of special rules and regulations of the invitation to tender.

They must be dated less than three (03) months preceding the date of submission of the tender, or must have been signed after the date of signing the invitation to tender.

Any offer not in conformity with the requirements of this notice and tender file will be declared inadmissible. Notably the absence of a bid bond issued by a first class bank approved with the Ministry of Finance, or failure to respect the models of documents of tender file will result in rejection of the offer.

  1. CONSULTATION OF THE TENDER FILE

Upon publication of this notice, the tender file may be consulted during working hours at SONARA, P.O. Box 365 LIMBE (GENERAL MANAGEMENT / CONTRACTS DIVISION).

  1. ACQUISITION OF THE TENDER FILE

Once the tender notice is made known, tender documents can be obtained at the Contracts Division of SONARA-PO Box 365 Limbé, upon presentation of a receipt of payment of a non-refundable amount of CFAF 1.000.000 (one million) payable to BICEC under the following references:

  1. SUBMISSION OF BIDS

Each bid drafted in English or in French in six (06) copies including one (01) original and five (05) copies labelled as such, shall be deposited against an acknowledgement of receipt at the Contracts Division  of the NATIONAL REFINING COMPANY Ltd (SONARA, P.O.BOX 365 – LIMBE, latest on the 14th/11/2019 at 10 a.m. local time, bearing the following label:

  1. ADMISSIBILITY OFFERS

Subject to rejection, other administrative documents required will imperatively be produced in originals or certified copies by the issuing authority in accordance with the provisions of special rules and regulations of the invitation to tender.

  1. OPENING OF TENDER ENVELOPES

The opening of bids will be done in two stages; the opening of the administrative and technical bids will take place initially and will be followed by the second phase which is the financial offers of the bidders who meet the minimum technical score required.

The opening of administrative documents and technical bids will take place on 14th/11/2019 at 10:30 am at the Company restaurant SONARA in Limbe, by the SONARA’s Internal Tenders Board.

Only bidders may attend the opening session or be represented by a person of their choice duly authorized.

The financial bids will take place at the end of the technical analysis and it will concern only tenderers with the minimum score of 70 points out of 100.

  • The bidder is in litigation with SONARA;
  • Failure to present inside the bid, a certificate of satisfaction issued by SONARA;
  • The bidder is under sanction by any regulatory authority at the time of submission;
  • Failure to obtained at least 70 points out of 100 when adding notes from the essential criteria.

  • The insurer is subject to the sanction of CIMA at the time of submission (attach proof of absence of sanction);
  • Lack of adherence to the CIMA Code (attach proof of CIMA Code membership);
  • Failure to obtained at least 70 points out of 100 when adding notes from the essential criteria.
  1. METHOD OF SELECTION OF THE SERVICE PROVIDER

The insurer shall be chosen following the best bidder’s method.

  1. MAXIMUM NUMBER OF LOTS

A pool of Insurance Underwriters may bid for one or more lots, but can not be awarded more than two (2) lots. In the event that a bidder is the best bidder for more than two (2) lots, the Contracting Authority will award him the two (02) lots of his preference as specified in his financial bid.

  1. AWARD:

The Contract will be awarded to the bidder whose qualified technical offer will be evaluated as the best bid on the basis of formula NG = 0.7 NT + 0.3 NF.

  1. TENDER VALIDITY

The bidders remain bound by their offers for a period of three (03) months with effect from the date of opening of bids.
